In these terms, "we", "us" and "our" refer to JAMZ Smash Burgers. "You" refers to anyone visiting this website or ordering from us.

2. Scope

These terms apply to your use of this website and to any order you place with us in the restaurant. By using the website or placing an order, you accept these terms. If you do not agree with them, please do not use the website.

We may agree separate written terms with you for specific arrangements, such as a large group booking or a catering order. Where we do, those separate terms take precedence over these ones for that arrangement.

3. Using this website

This website is provided for general information about our restaurant, our menu and our opening hours. You may view, download and print pages for your own personal use.

You agree not to use the website in any way that is unlawful, that damages or disrupts it, or that interferes with anyone else's use of it. You may not attempt to gain unauthorised access to the website, its server, or any connected system.

We try to keep the website available and up to date, but we do not guarantee that it will always be available or free from errors. We may change, suspend or withdraw any part of it at any time without notice.

4. Menu, prices and availability

All prices shown on this website are in euro and include VAT.

We work hard to keep the menu and prices on this website accurate, but the menu displayed in the restaurant is the one that applies at the moment you order. If a price on the website differs from the price in the restaurant, the price in the restaurant applies.

Menu items depend on availability. We may change, add or remove items, and adjust prices, at any time and without notice. Photographs and illustrations of food on this website are for presentation purposes; the item you receive may look different.

Portion descriptions such as "double" refer to the number of patties, not to a guaranteed weight.

5. Allergens and food information

We publish ingredient and allergen information for each menu item on our menu page, covering the fourteen allergen categories that must be declared under Regulation (EU) No 1169/2011.

Our kitchen is a single open kitchen with shared fryers, utensils and preparation surfaces. We therefore cannot guarantee that any item is completely free from a particular allergen, even where that allergen is not listed as an ingredient.

If you have a food allergy or intolerance, please tell a member of our team before you order so we can check the current product specifications with you. Recipes and suppliers change from time to time, so please ask us rather than relying on information you saw on a previous visit.

Information about allergens is provided in good faith and to the best of our knowledge. It does not replace a conversation with our team about your specific requirements.

6. Ordering and payment

Orders are placed and paid for in the restaurant. Displaying an item on this website or on our menu is an invitation to order, not a binding offer; a contract is formed when we accept your order at the counter.

We may refuse an order, for example where an item is unavailable, where we cannot safely accommodate a stated allergy, or where we reasonably believe the order is not made in good faith.

We accept the payment methods displayed at the counter. Because our food is prepared fresh to order and is perishable, the statutory right of withdrawal for distance and off-premises contracts does not apply to it. This does not affect your legal rights if the food we supply is not of satisfactory quality.

If something is wrong with your order, please tell us straight away and while you are still in the restaurant, so that we can put it right.

7. Intellectual property

The JAMZ name and logo, the design of this website, and its text, illustrations and graphics are owned by us or used by us under licence. They are protected by copyright and other intellectual property rights.

You may not copy, reproduce, republish or distribute any part of this website for commercial purposes without our prior written permission. You are welcome to share links to the site, and to post your own photographs of our food.

8. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited or excluded.

Subject to that, we are not liable for any loss or damage arising from your use of this website, from reliance on information published on it, or from its temporary unavailability. Information on this website is provided for general guidance and does not constitute advice.

Our liability in connection with an order is limited to what is provided under Belgian law.

9. Links to other websites

This website may contain links to third-party websites, such as map or social media services. We provide those links for convenience. We do not control those websites and are not responsible for their content, their availability or their privacy practices.

10. Privacy and cookies

This website does not ask you to create an account and does not collect personal data through forms.

Fonts used on this site are loaded from Google Fonts, which means your browser contacts a Google server and your IP address is transmitted to it when a page loads.

Where we do process personal data — for example if you contact us by telephone or e-mail — we do so in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679). You have the right to request access to your data, and to have it corrected or erased. To exercise those rights, contact us using the details in section 1.

11. Complaints

If you are not happy with your food, your visit or this website, please speak to us first — in the restaurant or using the contact details in section 1. We will do our best to resolve it quickly.

If we cannot reach a solution together, consumers in Belgium can contact the Consumer Mediation Service (Consumentenombudsdienst), North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussel — consumentenombudsdienst.be.

12. Changes to these terms

We may update these terms from time to time, for example to reflect changes in how we operate or in the law. The version published on this page is the version that applies. The date at the top shows when it was last changed.

13. Applicable law

These terms are governed by Belgian law. Disputes will be submitted to the competent Belgian courts. If you are a consumer, this does not deprive you of the protection of the mandatory rules that determine which court may hear your case.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue to apply in full.
